Hi Phil

Somewhere in this series of Francke posts I said I was going to make a related public records request. After researching and agonizing about where to put my energy towards that goal, I decided to start with a simple request that may or may not be denied and/or turn something up. So I made a request to DOJ for Scott McAlister's employment records (including a statement as to why the fees should be waived in the public interest ) to see how they respond. They got back to me as required within a week, and said they will be "searching for response records and will respond as soon as practicable" whatever that means. I'm not holding my breath but I will stay on top of it, just in case, and because why not? I'm thinking (hoping) if I get something from them maybe I'll see something there that at the very least creates an opening for a more specific records request that could lead to something substantive. I'll post in here if anything noteworthy transpires. Justice by a lick and a promise is about the size of it 😕. Or now we can say a "click" and a promise (sorry, I can't help myself 🙂).

So I got to thinking.......which is usually not a good thing........but I was wondering if you had ever felt threatened by anyone through all this......?? I mean.....there is a lot at stake for some.....and you have been reporting about this for years..........I was just wondering........

No serious threats – but then the people behind the murder and the cover-up wouldn't really have that much to gain with me out of the way. I don't have any first-hand knowledge. The ones who've been threatened are the ones who do. Also Kevin, who has been sort of the driving force behind this effort to solve the case. The police have tried to set him up to get shot at least twice that I know of.

All you can do is stir the pot.....and hope something/someone rises to the surface. Unfortunately....nothing yet. Too many layers of cover up and corruption......keeping those that could help.....afraid to come forward.....We read about cold cases being solved all the time. This case could be solved also. The difference is ......there are too many still alive, and with enough power, that don't want it solved. A pretty pathetic showing for the State of Oregon.

A lot of us appreciate your efforts....and hopefully there will be a break in the case soon.

Enjoy your break......will be looking forward to what 's next. :)

You tried.....and as an old cowboy once said....."That's all a steer can do"

Thank you for stirring shit up again. It's always worth a try! You got me all worked up with your substack and I'm not ready to let go yet.

I'm requesting the DOJ Gable appeal trial case file. It's now available since there are no more legal reviews of the appeal allowed. It's likely stuff we already know, but maybe something will stand out as material and more than circumstantial. It's an easy request to make as the trial records are no longer exempt, so why not?

Looking forward to reading more about the 70s and 80s! Thank you again for all your work on the Francke (and Gable) cases.

A winter poem for you:

Don't despair

Take care

Phil,

It is another well writen piece. Is Franke still alive? At least Franke did not get the death penelty by the fine work of the organization that I once was the President of: The Oregon Criminal Defense Lawyers Association. At least we saved money we would have spent on his Death case going up to Supremes. Again, it is the beauty of Oregon. When my friend Kate Brown was the Govrnor, I stayed in her Governor's Mantion. It is well guardeded with muscled cops and Dobernans on meth. I don't think she legalized Meth? Marajuana was legalized because of me, my name is in the statute.

Don't be a stranger 12550 SW 134th Ave., Tigard, OR 97223. Peace, man. Dr. Jim McHugh

Frank, what is the problem? Too many Franks, eh?. I apologize, Frank. By the way, just to be sure, I will not make the mistake again. I illegally changhed my name to Frank Franke. As should you, I hope our new Governor will see the obvious benefit of changhing every name in the State to Frank Franke. Join the club. As Ever, Frank Frankee HAHAHA.

Thank you. My mistake.

I thought Frank Gable was dead. Losers do not live that long. As a criminal defence lawyer for more than a decade I remember the calls. Your name seems framiliar.
